1. Who We Are
This Privacy Policy explains how NexCal handles information when you use the NexCal iOS app. In this policy, "NexCal", "we", "us", and "our" refer to the developer of NexCal.
2. Important Health Notice
NexCal provides nutrition estimates, wellness tracking, and recipe suggestions. NexCal is not a medical device, does not provide medical advice, and should not be used to diagnose, treat, cure, or prevent any disease or health condition.
AI outputs and nutrition estimates can be incomplete or wrong. You are responsible for reviewing results before relying on them. Consult a qualified clinician for medical conditions, pregnancy, eating disorder history, allergies, medication concerns, or any health decision.
3. Information You Enter or Create
NexCal stores the information you enter or create in the app so the app can work. This can include age, sex selection, height, current weight, goal weight, goal direction, weekly pace, activity level, diet preference, water target, calorie target, food entries, calories, macros, health scores, hydration logs, weight entries, saved recipes, ingredients, steps, and meal photo thumbnails.
This data is stored locally on your device and may sync through your private iCloud database. We do not collect it on our own servers, sell it, rent it, use it for advertising, or use it to track you.
4. Device and iCloud Storage
NexCal stores app data using Apple system storage on your device. The current app configuration also uses Apple's private CloudKit database for the app, which can sync supported app data through the iCloud account signed in on your device.
We do not operate this iCloud database as a developer-accessible user database for profiling, analytics, ads, or resale. Apple's iCloud, device backup, account, and operating system services are governed by Apple's terms and privacy policy. You can manage iCloud and app data through your device and Apple ID settings.
5. HealthKit
If you grant permission, NexCal reads selected HealthKit data, including active energy, basal energy, and body mass, to estimate your daily calorie balance and progress. NexCal does not write HealthKit data.
NexCal does not sell HealthKit data, use HealthKit data for advertising, or share HealthKit data with data brokers. You can change Health permissions at any time in the iOS Health app or Settings app.
6. Camera and Photos
When you choose to scan a meal, NexCal may access your camera or selected photos. The app uses the image you select or capture to prepare a compressed meal image for AI nutrition analysis. If you approve the result, NexCal may save a meal photo thumbnail with the food entry on your device and private iCloud, if enabled.
NexCal does not access your full photo library unless you grant the relevant iOS permission or select images through Apple's photo picker.
7. Optional OpenAI AI Features
NexCal does not send anything to OpenAI unless you choose an AI feature such as meal scanning or recipe generation. We do not route these requests through our own server and we do not keep a developer copy of the request or response.
For meal scanning, the request may include the meal image, prompt instructions, your calorie target, goal direction, and diet preference. For recipe generation, the request may include your craving/search text, avoid list, selected filters, calorie range, calorie target, goal direction, and diet preference.
NexCal sends OpenAI API requests with storage disabled where supported and does not opt in to OpenAI model training. OpenAI states that data sent to the API is not used to train or improve OpenAI models unless the API customer explicitly opts in. OpenAI may still process requests to provide the service and may retain limited data where required for abuse monitoring, security, legal compliance, or platform operation under OpenAI's API data controls.
Do not submit medical records, government identifiers, payment details, passwords, information about other people without permission, or anything you do not want processed by OpenAI. NexCal is a consumer wellness app and is not intended to create, receive, maintain, or transmit Protected Health Information under HIPAA.
8. Purchases
NexCal Pro purchases and restores are processed by Apple through StoreKit. Apple may process payment, transaction, refund, tax, account, and subscription information under Apple's own terms and privacy policy.
NexCal receives only the entitlement status needed to unlock paid features on your device. We do not receive your credit card number, bank details, Apple ID password, or full App Store account information.
9. Tracking, Ads, and Sale of Data
NexCal does not track you across apps or websites. NexCal does not include advertising SDKs, analytics SDKs, tracking SDKs, or data broker SDKs. We do not collect personal app data on developer servers, and we do not sell or rent personal data.
10. Third-Party Services
NexCal may rely on Apple services for iOS, HealthKit, iCloud/CloudKit, StoreKit, App Store purchases, entitlement checks, and system functionality. NexCal may rely on OpenAI only for optional AI meal and recipe features. If you contact support, information you submit is handled through the support channel you use.
Third-party services are governed by their own policies, including Apple's Privacy Policy and OpenAI's Privacy Policy.
11. Security and Retention
NexCal limits developer-controlled data handling by avoiding our own user data servers, user accounts, ads, analytics SDKs, tracking SDKs, and data broker SDKs. App data remains on your device and may remain in your private iCloud database, device backups, or Apple account services until you delete it or change your settings.
No method of storage or transmission is completely secure. Internet-based AI requests, Apple services, OpenAI services, your device settings, iCloud settings, backups, and support communications are partly outside NexCal's direct control.
12. Children
NexCal is not directed to children under 13. We do not knowingly collect personal data from children under 13. If you believe a child provided personal data through support or another channel, contact us so we can review and delete it where appropriate.
13. Your Choices
You can choose not to use AI meal scanning or AI recipe generation. You can manage camera, photo, HealthKit, iCloud, notification, and other permissions in iOS Settings. You can delete locally stored NexCal data by deleting the app, and you can manage iCloud app data through Apple settings where available.
You can manage purchases, subscriptions, renewals, cancellation, and refunds through the App Store and your Apple ID settings.
14. Changes to This Policy
We may update this Privacy Policy if NexCal changes. If we materially change the app's data handling, add developer-controlled user data servers, add analytics, add ads, add tracking, or use additional external services, we will update this policy and App Store privacy information as required.
